Disbarment recommended in the District of Columbia
The D.C. Board on Professional Responsibility recommended disbarment over the letter he drafted in December 2020 telling Georgia officials the Justice Department had "significant concerns" about the state's result and urging the legislature to consider a competing slate of electors. The Board found he "was prepared to cause the Justice Department to tell a lie about the status of its investigation of an important national issue", warranting disbarment "to send a message to the rest of the Bar and to the public that this behavior will not be tolerated". A hearing committee had found the year before that he "attempted dishonesty and did so with truly extraordinary recklessness". The recommendation is before the D.C. Court of Appeals.
